GWERU: In a recent court ruling, Gweru provincial Hospital medical Superintendent, Dr Fabion Mashingaidze was acquitted of assault charges following a report made by his subordinate in 2020.
Allegations were that Dr Mashingaidze lifted the complainant from a sofa where she was sited in his office and dropped her on the floor, thereby inflicting pain on the complainant’s left hip.
The court however noted that facts from the complainant were inconsistent neither did they tally with those of witnesses.
The court also found out that evidence of the other witness was irrelevant as he did not witness the assault but only came into the accused’s office and found the complainant on the floor.
In passing judgement, the court noted that there was no enough proof against the accused as all evidence was ‘grossly unreliable and conflicting such that their credibility was questionable.’
In that regard, this court will not take part in a charade of lies and as such the accused is found not guilty and acquitted,” the court also said in judgement.
